Mistake of Fact

One of our approaches is based on the successful challenge to a Planning Inspector’s Decision in the High Court in 2008 and the Court of Appeal in 2009, a case which has been used as a precedent in other planning cases.

The challenge was based on the obscure legal doctrine of common sense and showed that there can be some bad decisions in planning.

This is not always the case but with this in mind we look to see if there is another possible land use.
